What Is Spousal Support?
Spousal support is a form of support that one spouse may be required to pay the other when the couple divorces or separates. It is an aspect of law. Ontario spousal support guidelines allow spousal support to be paid in order to recognize the other spouse’s contribution to the relationship or relieve financial hardship. Alimony may also be paid to share child-rearing costs, help the spouse that may have lost out financially during the relationship, or for other reasons.
Who Pays Spousal Support?
The partner that earns more pays spousal support to the partner who earns less. However, spousal support is not granted automatically. You can only obtain it if the court has determined that you are entitled to it. However, even in these cases, Ontario spousal support law requires the spouse receiving support to try to support themselves after the divorce or separation, and as quickly as possible.
The person receiving support is referred to as the support recipient. The spouse that pays support is referred to as the support payor.
What Types of Relationships May Qualify for Ontario Spousal Support?
Partners who are married, as well as those in common-law relationships, may receive spousal support, and this applies to same-sex relationships as well.
How is the Payment of Spousal Support Determined?
The ideal situation is when the spouses can work out their own agreement regarding spousal support.
